Maharashtra: Ex-minister Anil Deshmukh approaches Bombay high court; seeks quashing of ED summons – Times of India

MUMBAI: Former Maharashtra home minister Anil Deshmukh filed a petition before Bombay high court for quashing of summons issued to him by the Enforcement Directorate (ED).
His petition came up on Thursday for the first time since it was filed on Wednesday, before a bench of Justice Revati Mohite Dere. The Judge recused herself.
The ED has issued five summons so far to appear before it.
The ED had registered its case under the Prevention of Money Laundering Act (PMLA) after the Central Bureau of Investigation (CBI) registered an FIR against Deshmukh and unknown others in April invoking the Prevention of Corruption Act (PCA) against him.
Deshmukh’s petition has sought setting aside or quashing of summons and also of “various other reliefs in the nature of direction” against the ED officer to permit the submission of documents or his statement through an electronic mode and attendance through an ‘authorised agent’.
He also sought orders from the ED to follow guidelines laid down by the Supreme Court in its 2014 landmark judgment in the Arnesh Kumar case on compliance with criminal law procedures.
He also has sought HC intervention and orders to “entrust the investigation to a Special Investigating Team (SIT) comprising ED officers outside Mumbai zonal office and to monitor/supervise” as laid down in an SC judgment in the Bahubhai Jamunadas Patel case.
The ED carried out raids on various premises in search of Deshmukh, earlier and claimed that his educational trust had allegedly received Rs 4 crore of ‘tainted money’ collected by now dismissed assistant police inspector Sachin Waze from bar and restaurants.
