By Vidya : Congress leader and former MP, Sanjay Nirupam, approached the Bombay High Court against the Mumbai Police’s refusal to grant him permission to hold a protest rally.

While seeking permission to hold the rally, Nirupam has also sought that an inquiry be held against those police officers who had detained him in November 2022 while rejecting his request to hold a bike rally in suburban Mumbai.

Nirupam, in his writ petition filed through advocate Ashok Saraogi, said that he is challenging the “attitude” of the State of Maharashtra and Mumbai Police in declining permission for the rally to be taken out by him, “though various such rallies are being taken out”. However, it was declined in his case.

Nirupam said that he wanted to hold a protest rally against the sitting MP from Mumbai North-West, Gajanan Kirtikar. Nirupam said that he wanted to highlight that Kirtikar had allegedly done no work in his constituency in the past few years.

Nirupam said that he had planned a bike rally on November 16, 2022, and for the same, he had applied for permission two days prior. He said, “Being a conscientious citizen and in order to avoid any inconvenience to the people at large, he had proposed that the rally be held during the afternoon hours when there is hardly any traffic on the route.”

He said that he did not get a reply from the police for the same, but on the day the rally was to be held, he was picked up from his residence and detained by the Versova police.

Later on November 28, Nirupam again applied for permission to hold a rally on December 4, 2022. However, on December 3, he got a reply from Mumbai Police stating that there could be a law and order problem as a large number of people would be visiting Chaitya Bhoomi, the resting place of Babasaheb Ambedkar in the Dadar area of Mumbai, and thus, it was rejected.

Then on December 12, Nirupam decided to hold another rally and this time asked Mumbai police only to choose any given date and grant him permission to hold a rally. But on December 20, he again got a reply from Mumbai police which rejected his request.

Nirupam’s plea is likely to be heard by the high court on February 1.
