Bombay High Court authorises demolition of century old dilapidated building in South Mumbai – Times Now

Mumbai: The Bombay High Court has authorised the demolition of a century-old, decaying structure in south Mumbai by the Brihanmumbai Municipal Corporation (BMC) and ordered the building’s inhabitants to vacate the area.

The HC stated that the “H N Petit Widows Home” building was situated on a busy road and could result in fatalities in the case of any adverse incident in an order issued on August 11 of which a copy was made available on Monday.

The BMC technical advisory committee (TAC) ordered to demolish the building because it is in a dangerous and dilapidated state, it was confirmed by a division bench of Justices R D Dhanuka and Kamal Khata.

In April of this year, the BMC sent a letter to the building’s landlord requesting that they vacate the property in light of the committee’s report.

However, a few building inhabitants and tenants who operate shops on the ground floor of the building refused to leave the premises and moved the HC, claiming that the building only required minor repairs.

The ground plus five level building is over a century old. It served to provide widows with hostel amenities.

The widows who were housed there were relocated to another hostel in 2019 due to the building’s deteriorating condition.

The TAC of the local body convened a structural audit meeting in October 2021, and it came to the conclusion that the building was in poor condition and would collapse, jeopardising the lives of both occupants and bystanders.

It stated that the structure ought to be torn down as soon as possible.

“It is an admitted fact that the said building is situated on a plot of land in a very congested and crowded area of Bhuleshwar (in south Mumbai) and lots of people are passing through the road on which the building is located,” the court said.
