Bombay HC asks state to find if there is facility in govt hospital for Wadhawan’s treatment – Times of India

MUMBAI: Bombay high court last Friday asked the state to inform the court if any state-run hospital in Mumbai has a “pacemaker implantation facility” that can be provided to businessman Rakesh Wadhawan accused of money laundering in the Punjab and Maharashtra Co-operative (PMC) Bank fraud case.
Justice Bharati Dangre on September 24, while hearing Wadhawan’s bail application, observed that the public prosecutor for the state had tendered a report from the Dean of KEM hospital of September 22 of his ‘current clinical status.’
Aabad Ponda senior counsel for Wadhawan also placed a report from a cardiologist who was permitted by the KEM dean pursuant to HC order to visit the accused.
The consultant concurred with the civic doctors’ advice of permanent pacemaker implantation for Wadhawan.
The HC order said, “the medical reports of the patient reflect that he requires immediate medical treatment of acute nature and at present, there is a concurrence in the opinion of the Cardiologists of KEM Hospital as well as Consultant Doctor, who has been allowed to monitor the health parameters of the Applicant, that the Applicant is in need of a pacemaker implantation.” adding “The question then arises is when and where it will have to be medically ascertained, whether the Applicant (Wadhawan) is fit for this implantation or he will have to wait and another question that arises is where the procedure can be carried out.”
The HC directed the state law to inform on the next date if there is any facility in any government hospital in Mumbai, if not, to offer an alternate solution.
Wadhawan’s petition seeks permission to carry out the procedure in a hospital of his choice and at his expense, while in custody.
The HC is to hear the matter again on Tuesday.
