Bombay HC grants interim relief for 53 BEd students in Bhiwandi college – Times of India

MUMBAI: Bombay high court vacation bench on Tuesday as an “interim measure’’ directed the state and its CET cell to permit 53 students of Kokan Muslim Education Society College of Education, to undergo their Bachelor of Education (BEd) course for academic year 2020-21.
The HC bench of Justices RD Dhanuka and Madhav Jamdar at the hearing via video conferencing in its order however made it clear that such admission would be subject to the outcome of the writ petition. The students shall be informed of such conditional admission, said the bench.
Uzair Kazi, counsel for the petitioner, the college, had sought permission to allow students to appear for their BEd examination which is to be held on May 27, 2021. He sought orders from court to the State CET cell to grant the college a ‘No Objection Certificate’ to complete admissions for its BEd course for 20-21 after completing their admission procedure. Additional government pleader P G Sawant and advocate Aadesh Sawant for the state Common Entrance Test (CET) cell opposed “vehemently’’ said the HC on the ground that the cut-off date for granting admission was over.
The college is located in Bhiwandi, Thane district.
The HC, however, noting an earlier interim order passed on March 10 in another similar matter, said it was inclined to grant relief to these BEd students too. The bench however, made it clear that the students who are allowed to appear for the May 27 exam “shall not plead any equity.’’
The HC directed the Mumbai University to issue hall tickets to the 53 students.
The HC also directed the State CET cell to grant its NOC without prejudice to its rights and contentions, to the university, during the course of the day, to enable issuance of hall tickets.
The HC posted the matter to June 14, for further hearing.
