Bombay HC rejects plea for admission to JBIMS course – Times of India

MUMBAI: No court can be a party to fraud, Bombay high court said on Tuesday while dismissing a petition by a candidate challenging cancellation of admission to the Master in Human Resources Development course at Jamnalal Bajaj Institute of Management Studies (JBIMS).
A bench of Chief Justice Dipankar Datta and Justice Girish Kulkarni heard a petition by the candidate, who was informed after four selection rounds and after paying Rs 3.5 lakh fees, that she does not fulfill the 55% eligibility for HSC. She had scored 51%.
Her advocate, Dhruti Kapadia, said she was innocent and JBIMS ought to have scrutinised her documents at the inception. “She should be allowed on humanitarian grounds,” she urged. But the judges said it amounted to fraud on the candidate’s part because knowing the eligibility criteria she could not have taken a chance.
Kapadia said her client was the sole candidate under VJNT category and among 20 selected out of 232 who were shortlisted. The judges said there may be similarly placed and more deserving candidates who did not apply as they would not qualify, and allowing her petition would be injustice to them. “We cannot be a party to fraud and allow the petitioner to be admitted to the course,” they concluded.
