Bombay HC seeks reply on reservation for transpersons in state-owned electricity firm – India Today

The Bombay High Court on Wednesday asked the Social Justice department of the Maharashtra government to make its stand clear regarding reservation for transgender persons in Maharashtra State Electricity Transmission Co Ltd (MSETCL).

By Vidya : The Bombay High Court has directed the Principal Secretary of Maharashtra’s Department of Social Justice to file a reply to the affidavit seeking reservations for transgenders in Maharashtra State Electricity Transmission Company Ltd (MSETCL), also known as Mahatransco.

A lawyer for Mahatransco told a bench of Acting Chief Justice SV Gangapurwala and Justice SG Chapalgaonkar that the company’s decision to hire transgender people was dependent on the state government’s stance. As a result, the court requested clarification from government pleader Manish Pable on the government’s stance on the issue.

The bench stipulated that a “positive affidavit” should preferably be filed by a senior member of the department, so it was asked that it be filed by the Principal Secretary.

Advocate Kranti LC, appearing for the petitioner, informed the court that the examination would be held online on December 29.

Kranti stressed that if the transgender person does not receive the reservation, they will miss out on the opportunity. However, he added that if the transgender engineer gets the reservation, they will be the only contenders in the race. In a lighter vein, the bench then said, “Then you’re safe.”

The petition was filed by Vinayak Kashid, a transgender with a degree in electrical engineering and a postgraduate degree in technology (electrical power system engineering). In May of this year, Mahatransco issued an advertisement inviting applications for various open positions in the company.

While the advertisement mentioned various reservation categories, Kranti stated that there was no mention of reservations for transgender people, despite the Supreme Court’s order that the Centre and states provide such reservations in government jobs.

Given this, Kashid’s petition sought that the advertisement be modified with the necessary changes and that the recruitment process be halted until the petition’s hearing was completed and an order was issued.
