JJ hospital tells Bombay HC: Dheeraj Wadhwan denied consent for a procedure on April 1 – Times of India

MUMBAI: State-run JJ Hospital on Wednesday submitted a status report on DHFL promoter Dheeraj Wadhwan an accused in the Yes Bank case stating that a nasal endoscopy is first necessary to find out if surgery is necessary.
It said however, Wadhwan, 42, had refused to give his consent to undergo the endoscopy at JJ hospital scheduled on April 1, despite being explained the procedure and repeated counselling.
Wadhawan, had challenged a special CBI court of last month order shifting him out of Kokilaben Dhirubhai Ambani hospital to JJ hospital from where he was shifted back to Taloja prison. But he is taken to JJ hospital regularly, said Central Bureau of Investigation (CBI) counsel Hiten Venegaonkar.
The CBI court held that the special PMLA (prevention of Money Laundering Act ) court order requiring Wadhwan to be kept in Kokila Ben hospital pending a second opinion of JJ was of no consequence and directed him to be shifted to JJ. The principal challenge in the HC by Wadhwan, represented by senior counsel Amit Desai with advocate Rohan Dakshini was that the CBI court can’t sit in appeal over the PMLA court order.
Desai also said he could not do the endoscopy at JJ as he is on blood thinners and first needs to be off the medicines for four-five days before the procedure and may need intensive care units, also that earlier Kokilaben hospital had given a report to trial court that he does need a nasal surgery so why should the procedure not be done in the super specialty hospital.
Venegaokar said before the special court CBI had sought a medical board to be set up to verify his health status, while questioning his long stay at Kokilaben hospital since June 2021.
Wadhawan was arrested on 26.4.2020 by the CBI and the ED arrested him on 14.5.2020.
The HC bench of Justice P D Naik who on Monday had called for the report from JJ hospital, now posted the matter for orders on Friday.
