Dr Tadvi suicide abetment case: Bombay HC permits Dr Hema Ahuja to leave Mumbai – Times of India

MUMBAI: Bombay high court on March 8 relaxed one of the bail conditions and allowed Dr Hema Ahuja accused in the Dr Payal Tadvi abetment to suicide case at Nair Hospital accommodation premises, to leave Mumbai. She hails from Madhya Pradesh.
Ahuja and two other accused were granted bail in August 2019 by the HC and one of the bail conditions was not to leave Mumbai limits without the prior nod of the trial court and report to the office of crime branch, Nagpada every alternative day till framing of charge, said her counsel Shyam Dewani. The attendance order was modified in February 2020. Seeking deletion of the travel condition, he said a similar condition was modified last December for the co-accused. He said she will remain present before the trial court except on ‘formal dates’ as the charge is yet to be framed.
Dewami said since her studies at BYL Nair Hospital, she is required to vacate the accommodation in Mumbai and will not be permitted to stay at the hostel.
Dr Pradeep Gharat special public prosecutor informed Justice Revati Mohite Dere that on formal dates an exemption application will not be opposed, but she must remain present on other dates for trial.
Relaxing the bail condition, the high court permitted her to leave Mumbai on certain terms and conditions.
The terms include that she must furnish the correct address of her proposed
residence to the trial Court. “In case of change in place of residence, the applicant shall furnish the particulars of the new place of residence” said the HC order and also, “shall furnish contact details like mobile number to the trial Court.” She has to “file an undertaking that she shal attend the Court on each day, unless her presence is exempted by the trial Court.’’
