Join both children to your guardianship plea: Bombay HC to MP – Times of India

MUMBAI: Bombay high court on Thursday directed a former MP to add her son and daughter as parties to her fresh petition to be appointed legal guardian of her ailing husband. The court said it would consider appointing them jointly with her as guardians.
A bench of justices Amjad Sayed and Madhav Jamdar heard petition by Rajkumari Ratna Singh in respect of her husband Jai Singh Sisodia who hails from a royal family in Rajasthan. Singh was thrice Congress MP from UP. She joined BJP in October 2019.
She had recently moved a petition to be appointed legal guardian of her husband and also caretaker of properties inherited by him under the Guardians and Wards Act. The State informed that it is applicable to minors. She withdrew it after the judges suggested that she file it afresh under Article 226 which gives HC wide powers to grant relief.
Her advocate Ashok Saraogi argued that since her husband is undergoing rehabilitation “someone has to manage the properties.” The judges enquired about the children and were told the couple has a daughter and son. “The son is a sitting MLA in UP. There is no dispute in the family,” said Saraogi. It was then that the judges said they would like both her children to be added as parties to her petition.
Government pleader Poornima Kantharia said Sisodia’s medical reports are not annexed with the petition. Also, Singh has not mentioned which provision of law she is invoking and should not put that responsibility on the State. “ Which act you are invoking?” she asked. Posting the hearing on February 3, the judges directed Singh’s children be added as party respondents and also to give particulars of the provisions of law being invoked.
